1. OVERVIEW

This website is operated by MimoBabys. Throughout these Terms, "we", "us" and "our" refer to MimoBabys, and "you" refers to any person who visits our website or purchases from us.

By visiting our website or purchasing from us, you agree to be bound by these Terms of Service, together with our Refund and Return Policy, Shipping Policy and Privacy Policy, which are incorporated by reference. If you do not agree to these Terms, please do not use our website.

We may update these Terms at any time by posting the revised version on this page. The version in force at the time you place an order is the one that applies to that order.

2. ELIGIBILITY

You must be at least 16 years old to use our website and place an order. If you are under 18, or under the age of majority where you live, you may only place an order with the involvement and consent of a parent or legal guardian, who accepts these Terms on your behalf.

3. PRODUCTS AND DESCRIPTIONS

We make every effort to display our products, their colors and their features as accurately as possible. However, colors may appear slightly different depending on your screen, and minor variations may exist between product batches. Images, including lifestyle photos, are for illustrative purposes.

We reserve the right to limit quantities, to discontinue any product at any time, and to correct any errors in descriptions or prices, even after an order has been submitted.

4. PRICES AND CURRENCY

Prices are shown in the currency of the market you are shopping from (US dollars, British pounds or euros) and may change at any time without notice. The price that applies is the one shown at the moment you place your order.

Any taxes, import duties or customs fees collected at checkout are shown in your order total. Where such charges are not collected at checkout, they may be applied by your country's authorities or by the carrier on delivery, and are your responsibility.

If a product is listed at an incorrect price due to an error, we may cancel any order placed at that price and issue a full refund.

5. ORDERS AND PAYMENT

When you place an order, you will receive an email confirming that we have received it. This confirmation does not mean your order has been accepted. A contract is formed when we ship your order.

We reserve the right to refuse or cancel any order, for example in case of suspected fraud, unauthorized or illegitimate use of a payment method, pricing errors or product unavailability. If we cancel an order after payment, we will refund you in full.

You agree to provide current, complete and accurate purchase and account information, including a valid email address and delivery address, and to update it promptly if it changes. We are not responsible for delays or failed deliveries caused by incorrect information you provide.

Payments are processed securely by third-party payment providers. We do not store your full card details.

6. SHIPPING AND DELIVERY

Processing and delivery times are estimates and are set out in our Shipping Policy. Delays caused by carriers, customs, weather or other events beyond our control do not entitle you to cancel an order that has already shipped, but you remain covered by our Refund and Return Policy.

7. RETURNS AND REFUNDS

Returns and refunds are governed by our Refund and Return Policy. Nothing in these Terms limits the statutory rights you have as a consumer under the laws of your country of residence.

8. SAFE USE OF OUR PRODUCTS

Our products are designed to make life with a baby easier, but they must always be used responsibly. When using the changing backpack and its bassinet:

- Never leave your baby unattended in the bassinet, not even for a moment.
- Always place the bassinet on a flat, stable surface at ground level or on a secure surface where it cannot fall.
- The bassinet is intended for supervised changing and short rests. It is not a replacement for a certified crib or bassinet for unsupervised or overnight sleep.
- Stop using the bassinet once your baby can roll over, sit up or push up on their hands and knees, or exceeds the size or weight limits indicated in the product instructions.
- Always read and follow the instructions and warnings supplied with the product.

We are not liable for injury or damage resulting from use that does not follow these guidelines or the product instructions.

9. INTELLECTUAL PROPERTY

All content on this website, including the MimoBabys name and logo, text, images, graphics and design, belongs to MimoBabys or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute or use any of it for commercial purposes without our prior written consent.

10. REVIEWS AND COMMENTS

If you submit reviews, comments, photos or other content to us, you confirm that it is truthful, that you own it or have the right to share it, and that it does not contain unlawful, offensive or misleading material. You grant us a non-exclusive, royalty-free right to use, reproduce and display that content in connection with our business. We may remove any content at our discretion.

11. PROHIBITED USES

You may not use our website or its content: for any unlawful purpose; to infringe our intellectual property or that of others; to submit false or misleading information; to upload viruses or malicious code; to collect personal information of others; or to interfere with the security or proper functioning of the website.

12. THIRD-PARTY LINKS AND SERVICES

Our website may contain links to, or use services provided by, third parties (such as payment processors and carriers). We are not responsible for the content, policies or practices of any third-party website or service.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, MimoBabys shall not be liable for any indirect, incidental or consequential loss arising from the use of our website or products. Our total liability in connection with any order is limited to the amount you paid for that order.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.

14. INDEMNIFICATION

You agree to indemnify and hold MimoBabys harmless from any claims, losses or expenses, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.

15. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of Spain. If you are a consumer, this does not deprive you of the protection of the mandatory consumer laws of your country of residence, and you may bring a claim before the courts of the place where you live.
